Terms and Conditions (End-User License Agreement – EULA) for NiniNana App
The NiniNana App is developed and provided by 22MEDIA s.r.o.
Effective Date: 10.5.2025
1. Acceptance of Terms By downloading, installing, or using the NiniNana App („App”), you agree to comply with and be bound by these Terms of Use. If you do not agree, do not install or use the App.
2. License Grant NiniNana grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial use in accordance with these Terms and applicable EU regulations.
3. Freemium and Subscription Plans The App offers a freemium version and a subscription plan. The subscription requires recurring payments made via credit card. Payments will automatically renew until cancelled by the user.
4. Account Creation and Parental Consent To access all features or services of the App, users must create an account. Primary users are children, who may access the service through an account created by their parent or guardian. Parents or guardians are responsible for granting access and monitoring their children’s use of the App.
5. Payment and Billing Payments for subscription plans must be made via credit card. Billing may not occur on the exact same date each billing cycle. If a payment does not arrive, NiniNana reserves the right to discontinue access to the subscribed services until payment is successfully processed.
6. Cancellation, Discontinuing Subscriptions, and Refunds Users can cancel their subscription at any time through their account settings or by contacting customer support. Cancellations become effective at the end of the current billing cycle. No refunds will be issued for partial subscription periods. If the subscription was purchased through a third-party service (such as the Apple App Store or Google Play Store), cancellations and refunds must be managed directly through that third-party service according to their terms and conditions. NiniNana does not process refunds for subscriptions purchased through these third-party services.
7. Free Trials and Promotional Offers NiniNana may offer free trials or promotional offers. These offers may require account registration and payment information. After the trial period ends, the subscription will automatically renew at the regular subscription fee unless cancelled by the user prior to the end of the trial.
8. Changes to Fees NiniNana reserves the right to change subscription fees at any time. Users will be notified in advance of any changes in subscription fees. Continued use of the App after the notification constitutes acceptance of the new fees.
9. Service Evolution and Changes to Terms As our services evolve, NiniNana reserves the right to change, update, or discontinue any parts of these Terms or any aspects of the App. Users will be informed of significant changes. Your continued use of the App following changes constitutes acceptance of the new Terms.
10. Restrictions You agree not to:
- Copy, modify, or create derivative works of the App.
- Reverse engineer, decompile, or attempt to extract source code from the App.
- Transfer, sell, lease, distribute, sublicense, or otherwise make the App available to third parties.
11. Intellectual Property All intellectual property rights related to the App, including content, graphics, and trademarks, are owned by NiniNana or its licensors. You do not acquire ownership rights through this license.
12. User Content If the App allows submission of content by users, you grant NiniNana a worldwide, royalty-free license to use, reproduce, and display such content in connection with the App, in compliance with GDPR and other relevant EU privacy laws.
13. Updates and Modifications NiniNana may periodically update the App. Updates may be automatic, and by using the App, you consent to these updates.
14. Disclaimer of Warranties The App is provided „as-is” without warranty of any kind. NiniNana expressly disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by EU law.
15. Limitation of Liability NiniNana is not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the App, subject to limitations and exclusions permissible under EU law.
16. Privacy Use of the App is governed by our Privacy Policy, available https://www.nininana.hu/privacy-policy-app-en/. By using the App, you agree to the terms of the Privacy Policy, compliant with GDPR and EU data protection laws.
17. Termination NiniNana may terminate your license to use the App at any time if you breach these Terms. Upon termination, you must cease all use and uninstall the App.
18. Governing Law These Terms are governed by the laws of the European Union and the jurisdiction of the Slovak Republic.
